Welcome to Refuge. These Terms and Conditions ("Terms") govern your access to and use of the Refuge application, website (refugeapp.ai), and all related services (collectively, the "Service") provided by Refuge Technologies LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of the State of Missouri.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. Please read them carefully.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not create an account, access the Service, or submit any personal information to us.

We reserve the right to request verification of age at any time and to terminate any account we reasonably believe belongs to an individual under 18 years of age.

2. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password or authentication credentials associated with your account. You agree not to share your account credentials with any third party. You are solely responsible for all activity that occurs under your account, whether or not you authorized such activity.

You must notify us immediately at support@refugeapp.ai if you become aware of any unauthorized use of your account or any other breach of security.

3. Nature of the Service

Refuge is an AI-powered companion designed for Christian-guided spiritual reflection and biblical dialogue. The Service uses artificial intelligence to facilitate conversations about faith, life, meaning, and personal growth.

REFUGE IS NOT A SUBSTITUTE FOR PROFESSIONAL COUNSELING, THERAPY, PSYCHIATRIC CARE, OR MEDICAL TREATMENT. The Service does not provide medical advice, mental health diagnoses, or clinical treatment of any kind. The AI companion is not a licensed therapist, counselor, psychologist, psychiatrist, or healthcare provider.

If you are experiencing a mental health emergency, suicidal thoughts, or thoughts of harming yourself or others, please immediately contact the 988 Suicide and Crisis Lifeline (call or text 988), call 911, or go to your nearest emergency room. Do not rely on Refuge for crisis intervention.

The spiritual, biblical, and reflective content provided by the Service is intended for personal growth and reflection purposes only. It does not constitute pastoral counseling, spiritual direction, or religious instruction from a qualified clergy member or spiritual director.

4. Subscriptions, Payments, and Billing

The Service offers both free and paid subscription tiers. Free accounts are subject to usage limitations as described on our website. Paid subscription plans ("Monthly" and "Yearly") provide additional features and higher usage limits as described at the time of purchase.

By purchasing a paid subscription, you authorize us to charge the payment method you provide on a recurring basis (monthly or annually, depending on your selected plan) until you cancel. All fees are stated in U.S. dollars.

Subscription fees are billed in advance at the beginning of each billing cycle. You will not receive a refund for any partial billing period when you cancel your subscription, and your access will continue until the end of the current billing period.

We reserve the right to change subscription pricing at any time. If we increase the price of your subscription, we will provide you with at least 30 days' notice before the price change takes effect. Your continued use of the Service after the price change constitutes your acceptance of the new pricing.

Payment processing is handled by Stripe, Inc. By providing payment information, you also agree to Stripe's terms of service. We do not store your full credit card number or payment credentials on our servers.

5. Free Trial

We may offer a free trial period for new users. The duration and terms of any free trial will be specified at the time of sign-up. Free trial accounts are limited to 5 messages per month and may have reduced functionality compared to paid subscriptions.

We reserve the right to modify, suspend, or discontinue the free trial offering at any time without prior notice.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period, after which your account will revert to free-tier access.

All sales are final. We do not offer refunds—full or partial—under any circumstances, except where required by applicable law. This includes, but is not limited to: partial months or years of service, unused message allocations, periods where you did not use the Service, dissatisfaction with the Service or AI-generated content, accidental purchases or renewals, or subscription downgrades or cancellations mid-cycle.

By purchasing a subscription, you acknowledge and agree that you are waiving any right to a refund beyond what is required by law. If you are unsure whether the Service is right for you, we encourage you to use the free tier before committing to a paid subscription.

7. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to: submit content that is illegal, threatening, abusive, harassing, defamatory, or obscene; attempt to gain unauthorized access to the Service, other accounts, or computer systems; interfere with or disrupt the integrity or performance of the Service; use the Service to harm, exploit, or endanger minors in any way; use the Service for any commercial purpose without our prior written consent; attempt to reverse engineer, decompile, or extract the source code or underlying algorithms of the Service; use automated means (bots, scrapers, etc.) to access or interact with the Service; or circumvent, disable, or otherwise interfere with any security or access-control features of the Service.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this policy, including without limitation suspending or terminating the offender's account and reporting such conduct to law enforcement authorities.

8. Content and Intellectual Property

User Content. You retain ownership of any text, messages, or other content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process, store, and transmit your User Content solely for the purpose of providing the Service to you.

AI-Generated Content. Responses generated by the AI companion ("AI Content") are provided for your personal use. AI Content may contain errors, inaccuracies, or omissions. You acknowledge that AI Content is generated by artificial intelligence and should not be relied upon as authoritative advice on any topic, including but not limited to theological, legal, medical, financial, or psychological matters.

Company Intellectual Property. The Service, including its design, code, AI models, system prompts, branding, logos, and all other proprietary technology, is the exclusive property of Refuge Technologies LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written consent.

Scripture references within AI responses are drawn from publicly available Bible translations. Refuge does not claim ownership of biblical text.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at refugeapp.ai/privacy to understand how we collect, use, and protect your information.

10. Data Retention and Deletion

We retain your conversation data for as long as your account is active or as needed to provide you with the Service. You may delete individual conversations at any time through the Service interface.

Upon account deletion, we will delete your personal data and conversation history within 30 days, except where we are required to retain certain information by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms).

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; (d) AI-generated responses will be accurate, complete, reliable, or appropriate for any particular purpose; or (e) the results obtained from the use of the Service will meet your requirements.

The AI companion may occasionally produce responses that are inaccurate, misleading, theologically incomplete, or contextually inappropriate. You are solely responsible for evaluating and acting upon any information provided by the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REFUGE TECHNOLOGY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY AI-GENERATED CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless Refuge Technologies LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party right, including without limitation any intellectual property right or privacy right; or (d) any claim that your User Content caused damage to a third party.

14. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

The arbitration shall be conducted in Jackson County, Missouri, unless you and we agree otherwise. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both you and we waive any right to a jury trial.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Refuge Technologies LLC agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Jackson County, Missouri.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your account.

17. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Refuge Technologies LLC concerning the Service and supersede all prior agreements, representations, and understandings.
